Ill-prepared UK plc can expect a rash of litigants
COMPANIES and big business are ill-prepared for the Human Rights Act and could find themselves the target of litigation as a result, according to a survey last week by CMS Cameron McKenna.
The survey, based on the views of directors, managers and chief executive officers at the FTSE 350 firms and the law firm's own top 250 clients, found widespread ignorance of the Act which takes effect next week.
Tony Marks, a partner at Camerons, said: "The Act has been planned for the past two years but 24 per cent of respondents have little or no knowledge of it or how it will affect their businesses. The findings reveal a lack of preparation by UK plc, which will lead to the rise in litigation predicted by 69 per cent of respondents."
The survey found that only 18 per cent of companies have reviewed their employment procedures, although more than half believe that the Act will have an impact on employee relations. Two thirds recognise that the monitoring of Internet and e-mail usage will be affected by the Act but only 18 per cent had amended their policies.
In general, reaction to the Act is mixed. Some 16 per cent viewed it as a "necessary convenience"; while 64 per cent thought it too early to say.
