Answer two questions. This is a synoptic paper. You should, therefore, illustrate your answers with relevant material gained in your study in any of the modules.
1. Explain by reference to any area of law you have studied, what a 'policy issue' is. In deciding cases through the mechanism of precedent, how much consideration can and should judges give to policy issues? (30 marks)
2. With reference to any area(s) of law, distinguish between law and morals. Consider how far it may be said that the law upholds the moral values of society? (30 marks)
3. With reference to decided cases in any area(s) of law with which you are familiar, consider to what extent English law is concerned with the concept of fault in deciding issues of liability or guilt. (30 marks)
4. Explain what is meant by 'justice'. Consider how far the courts achieve justice when attempting to balance the conflicting interests of the parties involved in civil and/or criminal cases. (30 marks)
