Task
Harry was a producer of stage musicals. He entered into a contract with the internationally acclaimed singer, Stella Tern, for her to star for six months in a musical version of 'Tristram Shandy' at the Bellevue Theatre in the West End of London. The show was written especially for Miss Tern. Great prominence was given to her role and personality in the pre-show publicity.
Miss Tern's fee was £150,000. One third of the fee was paid in advance. The rest was to be paid in five equal instalments.
Harry also entered into an agreement for the hire of the Bellevue for a term of six months at a rent of £20,000 per month. Other costs incurred by Harry in relation to 'Tristram Shandy' amounted to a further £500,000.
Harry seeks advice on issues of liability in relation to both Miss Tern and to the owners of the Bellevue in the event of the following, separate and unconnected, incidents:
(i) Three days before the first night Stella withdrew from the production because of a quarrel she had with Harry.
(ii) In the third week of the show Stella fell from the stage and was severely injured. She will not be able to perform on stage for at least a year.
In both incidents Harry felt forced to cancel all further performances. Advise Harry.
