Insurance is the answer
A GIRL of ten recently fell down a hole while riding her bicycle on a pavement. The hole had allegedly been left without adequate guard by workmen and she suffered severe bruising and cuts. Eighteen months later she still has scarring and nerve damage to her mouth, and suffers nightmares.
Her mother, an unemployed single parent in the Midlands, is one of many potential claimants benefiting from the new ways of bringing accident claims. She obtained legal aid but this was withdrawn when her barrister failed to meet the Legal Aid Board deadline for providing an opinion. She turned to Claims Direct after seeing an advertisement.
A home visit was made and a case file compiled which was referred to a panel solicitor. The cost of the policy, £1,312.50, is met by the company, which provides a loan to all customers whose cases are accepted. The loan is in fact provided by bankers, who have opened a £30 million line of credit to fund these advances to claimants.
The girl's case is now pending. She is one accident victim taking advantage of the way the insurance industry is revolutionising the accident claims market.
At the other end of the spectrum, Elaine Maberly, 60, of Yorkshire, the wife of a retired surgeon, suffered severe injuries in a riding accident. These included fractured vertebra, jaw and nose, and the loss of 12 teeth. Her upper lip was torn off.
She contacted Claims Direct and was referred to a panel solicitor. She has opted for the Claims Direct insurance scheme, which provides guaranteed cover of £50,000 for legal expenses and means that she pays nothing if the case is lost.
Alternatively, people can go to a specialist personal injury firm handling "no win, no fee" cases and, from next week, recoup the costs of any insurance premium. The insurance is crucial: a recent case backed by Litigation Protection involving a medical negligence lawyer failed, which could have left the claimant, an elderly woman who alleged damage to her sciatic nerve, with a bill for £80,000.
