If A, for valuable consideration, undertakes to surrender a copyhold to B, and B, on borrowing money from C, enters into a written agreement with C, that he, B will surrender the same copyhold to C by way of mortgage security, A is not justified in refusing to surrender the copyhold to B, because he, A, has received notice from C of the agreement between him and B. The surrender by A to B does not prejudice, but promotes, that agreement.
