AS Level Law Assignment 1 - The Court Structure
Task
Angel was injured in a road accident caused by the negligent driving of Diablo. Angel wishes to claim damages estimated at £15,000. Diablo has been charged by the police with causing death by dangerous driving, an indictable offence, as a passenger was killed.
(a) Advise Angel as to (i) where and (ii) how she could start civil proceedings against Diablo and (iii) how the action will proceed to trial. [15 marks]
(b) Explain to Diablo what will happen next up to and including the trial on indictment. [20 marks]
(c) Explain the appeal routes should Angel lose her civil action and Diablo be convicted following trial on indictment. [15 marks]
