Dear Mr. John Marsh, I have carefully read and understood all the legal issues involved in this matter. According to my expertise I consider you, being the general manager of Minnesota Vikings Professional Football Club, Inc. at a better position due to the fact that the plaintiff already agreed to attend the sports despite the risk warning associated with watching it as a waiver on the ticket and being fully aware that he will be liable to all personal injuries or damages, either attending the sports or travelling to and from it. Moreover it was also mentioned that the plaintiff will also not be able to claim for any losses even due to any tortuous acts of the Minnesota Vikings Professional Football Club, Inc. so he has already waived the defendant’s liability for any injury.

According to basic torts law, parties such as football clubs do owe a responsibility to provide a level of care to other parties to prevent injuries and damages and might be liable if this duty is breached but in your case no such apprehension is present as there has been no negligence on your side and the protective screen was present. However the plaintiff can argue on the point that the club was not able to provide a high level of care because there was minimal safety due to other drunken spectators which caused the actual accident. Measures should have been taken to remove or restrict them but again the risk warning was on the ticket and the plaintiff has ignored them and accepted a document that waived the defendant's liability or any injury suffered by the plaintiff.
Also the injuries suffered by the plaintiff are also fully recoverable with no permanent loss or damage so it also imposes no threat to the defendant in terms of liabilities and compensations.

 

Clauses in a general player’s agreement

After describing the names of both the parties and the date of actual contract, the other significant clauses in a general player’s agreement are as follows:

Term:

This states the dates of commencement and termination of a contract and shows the actual period of agreement between the parties. As mostly the contracts are continued for a year or so, this written documentation prevents from frauds and misunderstandings on either side.

Services and Obligations:

This clause refers for the purpose of the agreement and identifies the player’s methods of endorsing the company’s products .It also identifies the obligations on both sides and relates their duties and responsibilities. This contractual term ensures that the player attends all the relevant practices, meetings and conditioning sessions conducted by the team during the season this clause actually determines the job and ensures the deliverance with utmost loyalty and skills with no flaws to pursue ahead on either side.

Compensations:

This is one of the most important legal requirements which should be in the contract and includes the agreement about the basic salary; bonuses and other commissions received by the player and also describes the frequency of payment. This is essential to settle so that no further disputes can arise.

Expenses:

This describes the terms and conditions of the payments of all necessary and proper expenses of the player by the team including clothing, equipments, accessories, lodging expenses , meals, travelling expenses ,insurances etc. while the player is offering his services to the team. This obligation in the contract ensures the certainty of the well-being of the player and provision of all basic facilities during the course of events/games.

Conduct:

This identifies a code of conduct for the players and clarifies the rules and regulations which a player has to follow to display sportsmanship and demonstrate concern for the rights, safety and welfare of him and others. All players are made to agree to treat their coaches, team mates, competitors and referees with respect and courtesy and demonstrate self-control and discipline. In case of any violent or unacceptable behaviour or any conduct impairing the unfaithfulness of the player, fines or suspensions may be imposed. This set of rules draws boundaries for the players so that they stay loyal, honest and in their best behaviour at all times which can promote and upgrade their performances and enhance the teams’ reputation.

Confidentiality:

The team/club and the player agree that the financial arrangements settled between them will be kept confidential and will only be disclosed to legal/financial advisers or otherwise required by law. Health issues and fitness problems are also required to keep confidential according to the sports law. to keep the integrity of the player.

Termination:

Any behaviour or conduct that adversely affects the integrity of the game or discredits the team/club is taken seriously and often leads to termination of the contract. Any breach to terms and conditions as stated in the contract also results in termination. There are certain guidelines and obligations clearly stated in every contract which are necessary for the player to follow otherwise the consequence is termination so it is very important to discuss and document all such issues so that the team can maintain its position .

Some more provisions can also be added in the contract such as:

Arbitration :

In order to settle disputes between the team and the player arising under the contract or to resolve matters concerning the performance an arbitration procedure is set down to negotiate appropriately and resolve the issues in the best interest of both the player and the team.
Publicity and promotions: Teams require promoting themselves so it is essential for the player to participate in all such advertisements and publicity modes. The player shall allow taking pictures either alone or as a team, and will being involved in all still or motioning photography which will be used for promotional purposes. The team/club reserves the right of such pictures taken.

Prohibitions:

The player must be aware of the anti-drug law which clearly states that termination/disqualification will commence if the player is using the prohibited drugs with no obligation on the team/club to pay compensation under such circumstances.

These inclusions make the contract more comprehensive to avoid any further misunderstandings and clarify all the regulations.
