Client Care Letter

Solicitors should send out a retainer or client care letter in order to discharge their obligations under Rule 2 of the Solicitors Code of Conduct Rules 2007. This letter is usually sent out prior to the first meeting with the client. It will include the solicitor’s terms and conditions and information about payment, file storage, dispute resolution and the like.

Monies on Account

Payment will usually be required to cover the costs of the initial client meeting until a method of funding is agreed.

Conflict Search

A search will need to be carried out to establish whether the firm is acting or has previously acted for any of the other parties involved in the case. Any conflict will then need to be discussed both with the fee earner that has acted for the opposing party and the client.

Obtaining Documentation

All relevant information pertaining to the case and possible funding options should be requested from the client at the initial meeting.

Questionnaires

It is not uncommon for some firms to send out questionnaires to potential clients prior to the first meeting.
